In November of 2006 I sold a person some 9 inch hard rubber molds. This week that person informed me that he was returning them and demanded a refund. My questions are:

Should someone use you molds for 7 months and then return them without any type of penalty?

How much of the full purchase price be refunded? The cost was 60.00 per mold.

Am I under any obligation to accept them or refund any monies?

Any suggestions as to what is FAIR would be appreciated. I have never had any bad trader experiences with anyone before this and would like to do what is considered right. Thanks.........Bill

Are you serious? Tell him to get lost.

It's obvious he's just trying to scam you. What are molds used for? to make something. Well, he's made his something and now he wants a "refund". You're not a mold rental store.

Once he accepted your initial trade and left a positive ref, you are under no obligation to refund any of his money. The deal's done. I wouldn't refund anyone's money after 6+ months on anything, let alone something with a low reuse value like a mold.

Oh, and be sure to take your question out of the Bad Trader forum.
Trading Guidelines:
1. Lower rating ships first - even if I am purchasing.
2. If you agree to buy something, you have 72hrs. in which to pay. If payment is not received in 72hrs., I will automatically post a Non-Payment/Backout thread.
3. Refs are left upon positive receipt of goods, NEVER beforehand!
4. I accept Paypal & USPS money orders and charge for shipping AT COST. I make no profit from it.
5. I trade NIB/new models at retail.

Bill,
I don't know everything about what is going on but it really sounds kinda fishy to me. I'm gonna use something for over half a year and THEN ask for my money back? Uh I don't think so in my book. Things that would run in my mind as a outsider are:
1 Why is he returning them? Are they broken, not molding completely, or what? Did they ever work for him? Is it YOUR fault that it is not right?
2 If it is YOUR fault why was it not returned sooner?
3 If they never worked right, Why wait until now?
4 If they did work good and now when using them they are crappy through misuse (did you explain how to use?) why are they asking for money back?

As for how much money I would say "shove it" but definately NOT full price or even 50% IF IT IS NO FAULT OF YOURS!!

Your obligations are all direcly link to how much of his problems are from your own faults. No problems with your product = NO obligation on your part.

NOW THESE ARE ONLY MY OPINIONS!!!! I am not a Lawyer or a moderator. I enjoy modeling and love the hobby as a whole. All of this is just what I would consider. And as a fair trader If I was kinda at fault AND had this happen to me, I would ask for the mold back, inspect it for misuse/abuse, and send him another if it was poor Q/C on my part. Sure your out a little postage but I assume were talking about a big hunk of cash here.

I would just laugh at him unless he can somehow prove that the molds were dysfunctional.

What are the molds for? Seems curious that you don't mention that.

I'd not give him a refund, its well past any reasonable timeframe for a refund (I'd say a month at most, personally) for a mold.

There is nothing wrong with the molds and the guy owns a spincaster so he should have some knowledge of how to make figures. I doubt if anyone could afford a spincaster without knowing how to use it.

I never owned a casting machine and only bought the molds with the intention of having someone else cast the figures for me. Needless to say, like most hobby things, I never got around to it, so I decided to sell them.

The total price of the deal was about 570.00 for the molds to give you guys a frame of reference. Please check my Trader List ratings. I have nothing but positives.

I would not bother posting this if I didn't worry about my reputation. This is a hobby for me and is supposed to be fun.

I suspect that the guy cast up all the figures that he wanted and he doesn't need the molds any longer so he is trying to pull a fast one.

Yea Sounds like he's trying to screw you. With more info now it sounds like he is trying to pull a fast one and you'll take the brunt. $570??? Whew... That is a big chunk. While I lack Eric's subtle-ness I totally agree now. Tell him to go *f#@%* himself.

Ah Mr Eric....subtle like a baseball bat with railspikes in it.....I love it!!

If he still presses you might look into legal recourse, $570 IS a chunk of change!

I would accept them back, but inform him that as you thought it was a sale, you priced it as such, but since it was a LEASE, the new pricing is as follows:
$100.00 a month.

So he needs to send the molds back, along with a check for $200.00.

If not, you will have to post a bad trader refrence... :)

sorry, but that guy in my opinion is a Choad... I would like to know who it is so he can join the other 3 people on my "Do Not trade list!"

Yeah, tell him you'll charge a leasing fee. That'll shut him up real fast.

I don't, however, agree that you should publicly post his name. This isn't a BTR and we don't know the specifics behind this deal, so it wouldn't be right. I would suggest though that you forward his info on to one of the mods to file away. If this guy is trying to scam you, it'sonly a matter of time before he tries it with someone else.
