Here's a great place to start- in particular, the four factors determining Fair Use. OOP products are almost certainly considered to still be copyrighted unless otherwise stated- I'd check with the company. Also read Chapter 1- sections 107 to 118.

Yes. It is illegal.
Selling them only compounds the illegality and opens the forger to rather stiff monitary liabilities if they go to trial.

Actually, those links (excluding MM's indirectly) have little to nothing to do with the recasting GW minis. GW, being a UK company, would apply for copyright in UK:

Summary of advice in thread, given by a bunch of people who are not lawyers:
If you want to reproduce miniatures made by other people, you do so at your own risk. The safest bet would be to NOT DO IT, followed closely by consulting with a good Intellectual Property lawyer. One of our advertisers here on BT has done so, and continues to do a very brisk business in selling aftermarket parts for GW models.
There are keyboard cowboys (myself included) all over the internet who have very strong opinions about Copyright, etc. but what it comes down to is this: Unless they're lawyers or judges, their opinions are irrelevant, however well-informed they may be (myself included).
The report filed against a post was closed without action.
