Lack of detail is also a big one. Using gravity pours, I cannot achieve anywhere NEAR the level of detail that GW and other minis companies can achieve. This is because GW uses spin-casting to make all of their models. Spin-casting uses centrifugal force to force the molten pewter into a large disc mould.

Remember the set of spin-cast molds of GW minis on eBay? You could make some very high quality armies if you bought those obviously illegal molds, and had the spin-casting setup to use them...

No, I've not seen such a thing. I don't doubt it's happened, but havent' seen it myself.

I think the hard part about such a venture would be making back your investment into the spin-casting equipment before GW shuts your butt down. I'd certainly not try it, as I like owning my house and car, and don't want to hand them over to GW

Here's a great place to start- in particular, the four factors determining Fair Use. OOP products are almost certainly considered to still be copyrighted unless otherwise stated- I'd check with the company. Also read Chapter 1- sections 107 to 118.

Please keep this in mind:

The safest course is always to get permission from the copyright owner before using copyrighted material. The Copyright Office cannot give this permission.

Also consider that if enough people call to ask about something that is OOP and copyright protected, the company might even consider doing another limited run.

Yes. It is illegal.
Selling them only compounds the illegality and opens the forger to rather stiff monitary liabilities if they go to trial.

This is a super random question but is it illegal to cast oop models.

I saw a guy a while back cast an entire chaos dwarf army from oop models. He said it was to hard to get all the models he wanted so he made copy molds from his models and cast an entire army.

After that he then painted the whole army up and sold it. But I don't think there would have been anyway of knowing if they were copies if he didn't say so.

So this goes back to my question is it illegal to cast oop models and then use them?

My guess is yes but I have know clue. Im sure I could look it up somewhere but I wanted to here what people thought about this case in particular as well.

Read and school yourselves on the subject. Fair Use is a cloudy subject and a Judge will be the determing factor on whether it is Fair Use or not. Judges have ruled one way on a subject in favor of the plantiff, and then ruled on another case covering the same subject for the defendant.

Summary of advice in thread, given by a bunch of people who are not lawyers:

If you want to reproduce miniatures made by other people, you do so at your own risk. The safest bet would be to NOT DO IT, followed closely by consulting with a good Intellectual Property lawyer. One of our advertisers here on BT has done so, and continues to do a very brisk business in selling aftermarket parts for GW models.

There are keyboard cowboys (myself included) all over the internet who have very strong opinions about Copyright, etc. but what it comes down to is this: Unless they're lawyers or judges, their opinions are irrelevant, however well-informed they may be (myself included).

The report filed against a post was closed without action.
