Relisting items after a possible back out

Hello, thanks for looking to offer advice on how to handle this situation.
I recently agreed to make a rather large trade with another trader. The other trader had the lower reference rating (zero) so we agreed that I would ship after receiving his/her items. It is now 11 days past the date that the items were supposed to be shipped and 12 days since I have heard from the trader, despite two follow up messages I have sent. The last two messages I sent have not been read and according to the site the user hasn't accessed the site in 11 days. It seems to me that this is a back out and I would like to get my stuff posted up again so I can finally get rid of it.
My question is at what point can I safely assume that the trade is void and not be in danger of receiving a BTR if this trader suddenly appears again or ships before contacting me?
