Was I wrong?

Post by kill4koin »

Not sure I was right or wrong on this and would welcome some thoughts and feedback.

I had a bunch of models listed and was offered $x for 2 models (Model A and Model B). Model A represented about 2/3 of the agreed upon amount. We reached agreement on the price for models and shipping. About 6-8 hours later, a PM arrived informing me that the buyer didn't want to buy the more expensive Model A, but still wanted Model B and would I sell just that model, or he'd consider Model C (never part of the original deal) and he quoted me a new offer. I went back and reviewed several offers that included both Model A, Model B and many more models from my list. I accepted one of those offers and then advised the original trader that Model B wasn't available, but Model C was if he was interested....

The original trader isn't happy with me because he felt we had a deal for Model B.

My take is this:
We had a deal for Model A and Model B, but he undid the deal by canceling on Model A and thus negotiations started over. Because of the reset, I felt it was fair (to me and other traders) to review the offers that came in after his initial offer and his canceling of the original deal.

Am I seeing this wrong? Thanks for any feedback.

Nope, and nothing wrong on your part.

You had a deal with him for Models A&B
He broke the deal when he said he didn't want Model A but Model B&C(offering a new offer/starting negotiations over)
You declined his new offer and accepted another offer(which was in your right)

Provided there is no information that might come to light to change the facts...

You're correct.

You guys made a deal & he backed out (technically, you COULD file a BO report on him).
At that point, all deals were off. You didn't have any obligation to him.

I agree that you are in the clear. As long as it was he who changed the original deal you are in no way bound by it. Once the deal changed it became a new deal that needed to be fully worked through and agreed upon by both parties. Seeing as you didn't agree to the new deal then nothing counts as finalized.

Thanks for the responses. I think he was miffed that I worked out a deal before I responded and told him no on the newer, abbreviated deal. I was trying to get out of town for work and admittedly didn't PM him back until I was home 2 days later. I agreed that a short PM note to him would have been the right thing and that I was wrong on that count, but it's nice to know my thought process about the deal being "open" again is the right process.

the thought process was fine and understandable. And I do agree with you and the other posters.

With that being said, I have no bitter feelings. All is good.

You know, if either of you wants, send me the full PM string,(in chronological order please!,) and I'll see if I can figure out where things went south. Just to head off a public disagreement before it has the chance to rear its ugly head.

I didn't save the string. I didnt' want to go public other than to ask was I wrong in my thought process. I PM'ed the trader stating a simple PM would have been nice from me and admittedly, I was wrong in that regards. Thanks.
